How would it do that? It's just a reorganisation of existing public sector
functions. In effect, it moves the franchising function from the DfT to an
expanded version of NR.

What would be a poison pill is if a number of long (at least six years)
franchises without painless break clauses are awarded before the general
election. Similarly, a number of open access operations might be approved,
with long licences. These soon tend to become popular with passengers, so a
new government might be cautious about threatening them.
